3. Information on data processing
3.1 Fundamentals of data
processing
We process personal data only in compliance with the
relevant data protection regulations. This means that the data will only be
processed if legally permitted to do so, i.e. if the data processing is
required by law, if the user has given his consent or if data processing is
carried out on the basis of our legitimate interests within the meaning of Art.
6 (1) lit. f GDPR.
We use the data you provide to fulfill, process and,
if necessary, reverse your order.
Furthermore, your data can be passed on to the shipping company commissioned
with the delivery if this is necessary for the delivery of the goods.
3.2 Accessing our website
When you access our website, the browser used for this
on your end device automatically sends information to the server for our
website/application, which is temporarily stored in a log file. We have no
influence over this. The following information is also recorded without your
input and is stored until it is automatically deleted:
·
The IP address of the Internet-enabled device making
the request
·
The date and time of access
·
The name and URL of the file accessed
·
The website/application used to gain access (referrer
URL)
·
The browser you used and where applicable the
operating system of your Internet-enabled computer and the name of your access
provider.
·
The legal basis for processing the IP address is art.
6 para. 1 (f) of the GDPR. Our legitimate interest arises from the following
purposes for data collection. Remember that the data collected does not give us
any direct indication of your identity and we do not draw any conclusions in
this regard. We use the IP address of your end device and the data listed above
for the following purposes:
·
To ensure that a smooth connection is
established
·
To ensure that our website provides a good, consistent
user experience
·
To assess system security and stability
·
Tracking in case of a cyberattack
We also use cookies and tracking tools for our
website. The precise procedure and how your data is used for this purpose is
explained in further detail in sections about cookies and embedding of services
and third-party content.
3.3 Use of our service
Our service can be used to view contractual-, vehicle-

such services, you must register as a user. The following personal data is
processed as part of user registration and for the creation of service

User

the above-mentioned purposes is carried out in order to perform the contract on
the use of the product (cf. Art. 6(1) sentence 1 lit. b) GDPR).
3.4 Getting in touch
When you get in touch with us (via a contact form or
via email), the user details provided are used to process the request. The user
details may be stored in our Customer Relationship Management systems
("CRM system") or comparable request set-up to enable us to provide a

with our privacy policy and to comply with EU data privacy.
4. Use of cookies
4.1 General Information
We use cookies or other storage technologies (local
storage, session storage) of your browser on our website if you give us your
consent (cf. Art. 6(1) sentence 1 GDPR), we have a legitimate interest (cf.
Art. 6(1) sentence 1 GDPR) or it is technically necessary. These are small text
files that are sent from the product to the device that you use (PC, tablet
etc.) and stored in the memory of your browser. The purpose of these cookies
is, for example, to identify a user as an authorised user for the duration of
his use of the product. Without this temporary "intermediate
storage", entries already made in some applications would have to be made
over and over again. A cookie contains only the data that a server issues and/
or that the user enters on request (e.g. structure, domain information, path,
expiry date, cookie name and value). A cookie cannot spy out a hard disk. This
does not mean that we are immediately informed of your identity. The use of
cookies makes the use of our shop more pleasant for you. We use so-called
session cookies to recognize that you have already visited individual pages on
our website. These are automatically deleted after leaving our site. In
addition, we also use temporary cookies for the purpose of user-friendliness,
which are stored on your end device for a certain period of time. If you visit
our site to use our services again, it will automatically be recognized that
you have already been with us and what inputs and settings you have introduced
so that you do not have to enter them again.
In detail, the cookies mentioned in the following
overview are set when using the product. These are, on the one hand, so-called
first-party cookies, which we ourselves use, and, on the other hand, third
party cookies which are set by third parties to achieve certain purposes. If
you do not want cookies to be stored on your computer, you can deactivate the
corresponding option in the system settings of your browser. Cookies that have
already been saved can be deleted in the browser's system settings. However,
please note that deactivating cookies may restrict the use of the
product.
To give you an overview of the cookies in use and to
facilitate your consent or non-consent to the usage of cookies, we are using
the tool ‚Cookie Bot‘. At the beginning of your visit to our website, this tool
will ask your consent.
On the other hand, we use cookies to statistically
record the use of our website and to evaluate it for the purpose of optimizing
our offer for you and to display information specially tailored to you. These
cookies enable us to automatically recognize when you visit our site again that
you have already been with us. These cookies are automatically deleted after a
defined period of time. Most browsers accept cookies automatically.
However, you can configure your browser in such a way that no cookies are
stored on your computer or that a message always appears before a new cookie is
created. However, the complete deactivation of cookies may mean that you cannot
use all the functions of our website. The storage period of the cookies depends
on their purpose and is not the same for everyone. The respective storage
period of the cookies used can be found here.
Please visit
https://parts.jungheinrich.de/en/p/cookies for an overview of cookies in
use.
4.2 Google Analytics
For the needs-oriented design and ongoing optimisation
of our web pages, on the basis of art. 6 para. 1 (f) of the GDPR (legitimate
interest) we use Google Analytics, a web analytics service provided by Google
Inc. ("Google"). In addition the website uses the extension Google
Optimize. Anonymous usage profiles are created and cookies are used in
connection with this. The information generated by the cookie about your use of
this website, such as
·
Browser
type/version
·
language
settings
·
Operating
system used
·
Host name of the accessing computer (IP address)
·
Referrer URL (the previously visited page)
·
Time
of server requests
·
Pages viewed (URLs and page titles)
·
Events like PDF downloads, navigation clicks,
etc.
·
Usage behaviour such as length of stay, scroll depth,
cancellations
The collected information about your use of our
website is transmitted to a Google server via an encrypted connection (SSL,
HTTPS) together with a pseudonymous identifier (clientID) and stored
there.
We only use Google Analytics with activated IP anonymization. This means that
the IP address of the user is shortened by Google within member states of the
European Union or in other contracting states of the Agreement on the European
Economic Area. Only in exceptional cases the full IP address will be sent to a
Google server in the USA and shortened there. In addition to Google LLC based
in California, USA, the data transmitted and stored in this way could also be
accessed by US authorities in individual cases under certain legal
conditions.
Google will use this data on our behalf to evaluate
the use of our online offer by users, to evaluate the success of campaigns
(e.g. via the Google Ads advertising platform), to compile reports on the
activities within this online offer and to do other things with the use of this
online offer and services related to internet use to provide to us. Pseudonymous
user profiles can be created from the processed data.
We have set up Google Analytics in such a way that the data sent by us and
linked to cookies or clientIDs is automatically deleted after 14 months and
only aggregated data remains. Data whose retention period has been reached is
automatically deleted by Google once a month.
In general, users can prevent the storage of cookies and the execution of
scripts such as Google Analytics by making a corresponding setting in the
browser software or by using various plug-ins. However, we would like to point
out that in this case you may no longer be able to use all the functions of
this website to their full extent.
If you do not want Google Analytics to run, you can
also prevent this with effect for the future by using one of the following
options:
You can revoke your previously given consent to data collection at any time by
refusing the use of cookies and scripts for statistical purposes in our Cookie
Consent Manager.
You can download and install Google's official opt-out browser plugin from the
following link to deactivate Google Analytics on all websites in your current
browser: https://tools.google.com/dlpage/gaoptout
You can use this link to set an opt-out cookie that will prevent future detection
by Google Analytics within this website with your current browser. However, if
you delete the cookies in your browser, you must set this opt-out cookie
again.

5. Embedding of services and
third-party content
5.1
FriendlyCaptcha
We use the “Friendly Captcha” service from Friendly
Captcha GmbH, Am Anger 3-5, 82237 Wörthsee on our website. Friendly Captcha is
used to check whether data is entered on our website (e.g. in a contact form)
by a human or by an automated program. For this purpose, Friendly Captcha
analyzes the behaviour of the website visitor based on various characteristics.
Friendly Captcha evaluates various information for analysis - this also applies
to the IP address of the website visitor, which is immediately anonymized by
Friendly Captcha.
The data processing that takes place in connection with the use of Friendly
Captcha is carried out for the purpose of being able to guarantee the security
of our websites. The legal basis for data processing is Art. 6 (1) (f) GDPR.
Our legitimate interest lies in the fulfilment of legal requirements to ensure
the security of data processing. Further information on how Friendly Captcha
handles your data can be found on the website and in the data protection declaration
of the provider, which can be accessed via the following links:
https://friendlycaptcha.com/de/ data protection declaration:
https://friendlycaptcha.com/de /legal/privacy-end-users/
5.2 Google Tag Manager
On the basis of our legitimate interest (i.e. interest
in analysis, optimisation and economical running of our online offering as
defined in art. 6 para. 1 (f) of the GDPR), this website uses Google Tag
Manager. This service enables the management of website tags via an interface.
Google Tag Manager simply implements tags. No cookies are placed, and no
personal data is captured. Google Tag Manager triggers other tags that may
capture data. Google Tag Manager does not access this data. If deactivated at
domain or cookie level, deactivation applies for all tracking tags, insofar as
they are implemented using the Google Tag Manager. More information on Google
Tag Manager can be found at the following link:
http://www.google.de/tagmanager/use-policy.html
With this service, so-called website tags can be
managed via an interface. The Google Tag Manager implements scripts and general
services on our website according to defined rules and triggers, which in turn
may then use cookies, tracking pixels or comparable technologies and collect
data. The Google Tag Manager itself does not act as a tracking or analysis
service, but only enables the integration of such as well as the integration of
opt-out scripts (possibility of objection) and the like. In this function, the
Google Tag Manager is an important tool for us to fulfill transparency and
legal obligations in the area of data protection. For example, based on your
consent, we can use our Cookie Consent Manager to control whether analysis or
advertising services should be integrated or not.
You can find more information about Google Tag Manager and data protection at
Google under the following links:
https://marketingplatform.google.com/about/analytics/tag-manager/use-policy/
https://policies.google.com/privacy
https://policies.google.com/terms
The user has the option of preventing the Google Tag
Manager from sending statistical and marketing tags in the future. To do this,
the user must click on the following opt-out link to store a Google Tag Manager
deactivation cookie in their browser. This blocks future integration via the
Google Tag Manager for this browser only and not for other browsers and/or end
devices. This does not delete existing cookies. We also point out that in this
case you may no longer be able to use all the functions of this website to
their full extent. If the cookies are deleted in the browser, the opt-out
cookie must also be set again afterwards.
5.3 YouTube
On the basis of our legitimate interests (i.e.
interest in analysis, optimisation and economical running of our online
offering as defined in art. 6 para. 1 (f) of the GDPR), functions of the
YouTube service are embedded into the Jungheinrich AG website in order to
display and play back videos. These functions are provided by YouTube, LLC 901
Cherry Ave. San Bruno, CA 94066 USA. You can find further information in the
YouTube data privacy regulations.
Here, an advanced data privacy mode is used whereby,
according to information from the provider, user information is stored only
when video playback is initiated. If you start to play back an embedded YouTube
video, YouTube uses cookies to gather information on user behaviour. According
to information provided by YouTube, this is used, among other things, to create
video statistics, to improve user friendliness and to prevent misuse.
Regardless of whether the embedded video is played back or not, every time the Jungheinrich
AG website is accessed a connection to the Google "DoubleClick"
network is established, which can trigger further data processing beyond the
influence of Jungheinrich AG.
Users can find further details on how YouTube uses
cookies in the YouTube data privacy declaration at:
http://www.youtube.com/t/privacy_at_youtube.
6. Transmission of data to third
parties
We cooperate with third parties who take over certain
technical tasks in the provision of the product on our behalf.
As far as we involve external service providers, it
always happens in accordance with the legal provisions and the regulations of
the current privacy policy. Recipients of the data are obliged to use them only
for the defined purposes. In the event of data being transferred to a recipient
outside the Jungheinrich Group in a third country outside the European Union/EEA,
the recipient guarantees an equivalent level of data protection in accordance
with Art. 44 ff. GDPR. Exceptions are states whose data protection level has
been recognized as appropriate by the EU Commission pursuant to Art. 45
GDPR.
Our service provider Microsoft carries out the access
control and login. Only the data required for this purpose (e.g. access data)
is transmitted to the service provider.

processing at any time in accordance with Art. 21 Para. 2-4 EU-GDPR. To do
this, it is sufficient to send a corresponding e-mail to datenschutz@jungheinrich.de.
The special case of a legally required data blocking instead of data deletion
according to Art. 17-19 EU-GDPR remains unaffected.
8. Data security
We implement technical and organisational security
measures in accordance with the state of the art to ensure that the
requirements of European and national privacy law are observed and to protect
the data processed by us against accidental or intentional manipulation, loss,
destruction or against access by unauthorised persons. In particular, all communication
in connection with the visit and use of the product, which takes place via the
browser, is encrypted using the TLS procedure.
We also use appropriate technical and organizational
security measures to protect your personal data stored by us against
manipulation, partial or complete loss and against unauthorized access by third

technological developments.
9. Duration of the storage of your
personal data
In principle, we only store your data for as long as

storage takes place if legal retention periods apply or you have declared your
consent to the storage for a longer period of time.
The obligation of Jungheinrich to retain a copy of the
data for legally prescribed archiving purposes or other purposes provided by
the underlying contract remains unaffected.
User accesses are retained until a deletion is
initiated by the user. The deletion of the user access can be performed by
addressing your request to your customer contact or the Data Protection Officer
(see section 2. of this Policy). After final termination of the contract for
the use of the product or deletion of the user profile, we will initially restrict
access to the registration data and delete them as soon as they are no longer
required for asserting, exercising or defending legal claims.
